By downloading or using LiveLens, you agree to these Terms & Conditions. Please read them carefully before using the app.

These Terms & Conditions (also referred to as the "Terms", "Agreement", or "EULA") are a legal agreement between you ("you" or "User") and Binary Work, LLC ("we", "us", "our" or "Company"), governing your access to and use of the LiveLens mobile iOS application (the "App") and relatedservices, websites, and content (collectively, the "Service"). By downloading, installing, accessing, or using the App or Service you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non‑exclusive, non‑transferable license to use the App on devices you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Description of Service

LiveLens is an AI‑powered application that allows users to upload images and generate animated videos using artificial intelligence models. Content generated by the Service is created automatically. Results may be inaccurate or inconsistent and may not always 100% match user expectations.

You acknowledge that the animated videos are results of automated artificial intelligence processes. As such, outputs may contain visual artifacts, inaccuracies, or unexpected interpretations of your provided images. Binary Work, LLC does not guarantee the likeness, quality, or photorealism of any generated content.

The Service relies on third-party infrastructure providers. We are not liable for any service interruptions, data loss, or generation failures caused by these third-party providers, though we will make reasonable efforts to ensure "credits" are not consumed for failed generations.

The Service allows users to:

  • Upload images
  • Select animation prompts
  • Generate animated videos
  • View previously generated results

3. AI Processing and Ownership

To generate animations, uploaded images are transmitted to third‑party AI infrastructure providers (fal.ai). Ownership of Output: Subject to your compliance with these terms, Binary Work, LLC hereby assigns to you all right, title, and interest in and to the animated videos generated by the Service using your content.

4. User Content

You may upload images to generate animations. You represent that you either own the content you upload or have permission to use it. You grant Binary Work, LLC a license to store and process this content solely to provide the Service to you.

5. Safety and Prohibited Uses

LiveLens has zero tolerance for objectionable content. You agree NOT to use the Service to:

  • Violate applicable laws.
  • Infringe intellectual property rights.
  • Create, upload, or distribute Child Sexual Abuse Material (CSAM).
  • Generate non-consensual sexual content or deceptive "deepfakes."
  • Harass or harm individuals.
  • In accordance with applicable transparency laws, videos generated by LiveLens may contain digital watermarks or latent metadata identifying the content as AI-generated. These identifiers are intended to ensure digital provenance and prevent the spread of deceptive media. You agree not to remove, bypass, or alter these identifiers.

Reporting: Users may report objectionable AI-generated content via the "Report" button in the App or by emailing support@livelens.app. We reserve the right to ban users who violate these standards.

6. Moderation

We reserve the right to limit, suspend, or terminate access to the Service if we believe the Service is being used in violation of these Terms or applicable laws.

7. Storage of Content

The Service may store uploaded images and generated videos so users can access their creation history. We do not guarantee permanent storage.

8. Purchases and Subscriptions

The App offers subscriptions and one‑time "tickets." All billing and refunds are managed by Apple. If an AI generation fails due to a technical error, the ticket will not be consumed or will be returned to your balance. Unused tickets allocated as part of a subscription period will expire at the end of that period and will not carry over to the next. Subscriptions may be managed or cancelled in your Apple ID Account Settings.

9. Warranty Disclaimer

To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind, either express or implied. Binary Work, LLC does not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Binary Work, LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in courts located in San Luis Obispo County, California.

12. Apple App Store Terms (EULA)

Acknowledgment: You acknowledge that these Terms are between you and Binary Work, LLC only, not Apple. Binary Work, LLC is solely responsible for the App. Apple has no obligation to provide maintenance or support. In the event of an intellectual property claim, Binary Work, LLC (not Apple) is responsible for investigation and defense. Apple and its subsidiaries are third-party beneficiaries of these Terms.

If you believe content in the Service infringes your copyright, please notify our Copyright Agent at support@livelens.app in accordance with the Digital Millennium Copyright Act.

14. Changes to These Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of the revised Terms.
